1.      CALL TO ORDER

Mayor Rines called the meeting to order at 7:10.

2.      ROLL CALL

3.      PETITIONS, COMMUNICATIONS, RESOLUTIONS, & PUBLIC HEARINGS

3.1     Consideration of Comments from the Public on Issues that
           Do Not Appear Elsewhere on the Agenda (Please limit comments
          to five minutes.)

Phyllis Gardiner introduced Judy Lloyd, the new Executive Director for Johnson
Hall.  The Council welcomed Ms. Lloyd to the position.

3.2     Public Discussion of Big Apple Store.

Many Gardiner residents met with the City Council and CN Brown President to voice their concerns about the proposed Big Apple Convenience Store that will be located at the previous 7-Eleven Store site.  Some of the concerns that were brought to the Council’s attention were:
Canopy – structure/sign
Traffic/concern over gas tanks
no formal process to notify abutters
landscape or buffer zone
stop sign at corner
canopy not consistent with neighborhood
amendment to city ordinance
Historic district/central business district boundaries

After the discussion the President Ms. Dureya of CN Brown made a statement to the City Council and Gardiner residents.  The offer that was made to the City of Gardiner was that CN Brown would be willing to change the color of the canopy to white with the Citgo lettering with no cost to the City of Gardiner.  

The City Council went into a recess.

4.      CONSENT AGENDA

4.1     Consideration of Accepting January 2004 Warrants

4.2   Consideration of Appointing Councilor Dellert to sign February 2004
        Warrants.

Motion by Councilor Hart and seconded by Councilor Doiron to Accept Consent Agenda Items 4.1 & 4.2.

Vote: 8 in favor 0 – opposed Motion: passes

Motion by Councilor Hanley and seconded by Councilor Dellert to add Addendum Items.

Vote: 8 in favor 0 – opposed Motion: passes

2.      Public Hearing for Liquor License Renewal for Gardiner Lions Club.

Public Hearing opened at 9:42 pm and closed at 9:43 with no public comment.

3.      Consideration of Liquor License Renewal for Gardiner Lions Club.

Motion by Councilor Webster and seconded by Councilor Hanley  to Accept Liquor License Renewal for Gardiner Lions Club.

Vote: 8 in favor 0 – opposed Motion: passes

4.      Consideration of Cobbossee Corridor Master Planning Stakeholder’s    
            Committee.

Motion by Councilor Webster and seconded by Councilor Dellert  to Accept Cobbossee Corridor Master Planning Stakeholder’s Committee.

Vote: 8 in favor 0 – opposed Motion: passes

        

Mayor Rines stated that the City Council would go into Executive Session and take up Items 5-7  and Addendum Item 5 at the next Council meeting.

5.      NEW BUSINESS

5.1     Consideration of Resolution 04-03, Sewer Rate Discount “Downtown Redevelopment Opportunity Program”

5.2     Consideration of FY 05 Goals Statement.


5.3     Consideration of Ordinance 04-04, Amending Victualers License Provisions.

6.      CITY MANAGERS REPORT

No City Manager Report

7.           COUNCIL DISCUSSION AND PUBLIC COMMENTS

No Council Comment

Harvey Devane stated to the Mayor and Council that the sewer bills in Gardiner are the worst in Maine and wishes that something could be done to help the citizens of Gardiner.
