1.      CALL TO ORDER

Mayor Rines called the meeting to order at 6:30

2.      ROLL CALL

3.      CONSENT AGENDA

3.1     Consideration of Mayor Appointments.

Mayor Rines appointed :

Francine Bott  & Bob Harvey Webster to the Wastewater Advisory Board
Derrick Grant to the Historic Preservation Commission.
Wayne R. Jortner, Esq. to the Board of Assessment Review.
Jeffrey Kobrock as a Trustee of the Water District.
Judith Skehan will move from alternate seat on the Zoning Board of Appeals to a regular seat.

Motion by Councilor Hanley and seconded by Councilor Dellert to Accept the Mayor Appointments.

Vote: 7 in favor 0 – opposed Motion: passes

Motion by Councilor Rambo and seconded by Councilor Nickless to go into Executive Session at 6:35.
Vote: 7 in favor 0 – opposed Motion: passes

3   EXECUTIVE SESSION per MRSA, Title 1, Chapter 13, Section 405
       (6) (A)

Out of Executive Session at 7:30 pm. The Council directed the person  consulting to gather information to share in a workshop in June about the evaluation measures.
Mayor Rines asked if there were any objections to adding an Addendum Item, there were none.

Consideration of a Real Estate Matter.
Manager Kobrock Stated that the City received a letter from George Heselton, a resident on Dresden Avenue is selling his home and needs a quiy claim deed from the City of Gardiner, releasing the right of way path on his property.  The Council directed the City Manager to check to make sure that there were no underground drainage pipes that the City needed access to.  The Council will discuss again the next meeting.

4.      COUNCIL DISCUSSION AND PUBLIC COMMENTS

Councilor Hanley received a letter from the National Historic Landmark Program to update the landmarks in town.  Does the City certify the local landmarks? Manager Kobrock stated the only recognized historical district is downtown and there has been discussion over the years about doing a residential historical district, but nothing has ever been done.  

Councilor Doiron  asked if the City had a residential historic property area, would that increase property taxes? Manager Kobrock stated that it would make the residences eligible for certain tax credits.  Councilor Doiron also stated that the Johnson Hall Task Force met for the last time yesterday, they will be meeting before the Council on June 17th with the final report.

Councilor Rambo stated that the Planning Board/Barndoor Committee Workshop is June 2nd at 6:00 pm.  He stated that he noticed in the packet that there were minutes from the Planning Board April 21 meeting, wondered when the Contract Zoning Amendment would be coming before the Council.  Manager Kobrock stated that it has been received and will be on the Council Agenda soon.  Councilor Rambo also stated that the Maine Municipal Association website is very informative and interesting if you register.  There will be a MMA 2004 Technology Conference June 10th, which sounds very interesting if anyone is interested in attending.  Mayor Rines stated that the Council has an expense line in the budget that makes it available to the Council to attend events, if interested.  Councilor Rambo stated that at the end of the last Planning Board/Barn Door Committee meeting a resident approached the committee with some ideas that had some merit to be discussed but she needed a Councilor to represent her and she has approached Councilor Dellert to sponsor her.  Councilor Dellert stated that she told Ms. Washburn to write up the suggestions/changes and she will accompany when she approaches the Planning Board.  Manager Kobrock stated that the Ordinance has been sent to KVCOG to be reviewed, and asked for the Ordinance to be returned and do revisions all at once.


Councilor Hart stated that he almost was hit by a car near the Chapman’s crossing at the corner of Water and Bridge Street, because Chapman’s Exon displays their tires, encroaching onto the sidewalk, Councilor Hart suggested that the City approach Mr. Chapman about the problem, it is dangerous.   Manager Kobrock stated that Mr. Chapman has been spoken to numerous times and he will speak to him again.

Gloria Fitzherbert from Randolph was attending as a citizen with concerns about Jeff Kobrock being appointed as Trustee to the Water District.  Ms. Fitzherberts concerns were that with Manager Kobrock being the City Manager for Gardiner, there would be a conflict of interest, and asked the Council to reconsider.  Mayor Rines stated that he checked with the City Solicitor for an opinion and was informed that there would be no conflict, the only conflict would be if it would be a member of the Council.
