1.      CALL TO ORDER

In the absence of Mayor Rines, Councilor Hanley called the meeting to order at 6:37 pm.

2.      ROLL CALL

3.   PETITIONS, COMMUNICATIONS, RESOLUTIONS, & PUBLIC HEARINGS

3.1          Public Hearing for Amendment to Pine Tree Development Zones.

Public Hearing opened at 6:40 pm.  The Pine Tree Development Zones was previously established, but now needs an amendment to add parcels on Griffen Street, Brunswick Rd, Commonwealth Street, and Lions Ave.  Dorothy Washburn stated that the list on the website listed a lot of conflicting lots.  The Council expressed concern to make sure that the parcels indicated on the resolution that are outside the planned development or planned industrial zoning be struck.  The Public Hearing closed at 6:47.  

3.2          Consideration of Comments from the Public on Issues that
           Do Not Appear Elsewhere on the Agenda (Please limit comments
          to five minutes.)

Councilor Hanley remarked that he became a grandfather of a baby boy at 3:30.

4.        NEW BUSINESS

4.1     Consideration of Order 04-26, Extend Fiscal Year 2004 and Allow the City to Conduct Business until the Fiscal Year 2005 is Adopted.

Motion by Councilor Dellert and seconded by Councilor Webster to Accept Order 04-26, Extend Fiscal Year 2004 and Allow the City to Conduct Business until the Fiscal Year 2005 is Adopted.

Vote: 7 in favor 0 – opposed Motion: passes.

4.2     Consideration of Resolution 04-27, Amendment to Pine Tree Development Zones.

Motion by Councilor Doiron and seconded by Councilor Dellert to Accept Resolution 04-27, Amendment to Pine Tree Development Zones providing that any lots indicated on the resolution that are outside of planned development or planned industrial be struck.

Vote: 7 in favor 0 – opposed Motion: passes

Councilor Hanley asked if there were any objections to Adding Addendum Items, there were none.
 
Consideration of Cable Infrastructure for Libby Hill Business Park.

Chris Paszyc, Economic Development Director stated that the Libby Hill Business Park tenants are requesting cable service from Adelphia.  It will cost $11,800 to wire the park for existing tenants and the currently undeveloped lots where cable lines will pass.  The cost will be borne by existing tenants willing to pay and built into future lot sales.  Fair share for each user is $1,685 ($11,800 total).

Motion by Councilor Rambo and seconded by Councilor Hart to Accept Cable Infrastructure for Libby Hill Business Park.

Vote: 7 in favor 0 – opposed Motion: passes

Councilor Hanley recessed the Council Meeting to go into Workshops at 7:15 pm.

5.      CITY MANAGERS REPORT

Manager Kobrock remarked that he would distribute a package of materials that would be discussed after his report.  Manager Kobrock stated that Pam Fogg was scheduled to meet with the Council for this evening but was not prepared and asked to be on next weeks schedule.  Mayor Rines stated that he was not going to be in town next week, along with other Councilors with conflicts.  It was decided that Pam Fogg would come to meet with the Council on July 15th. The regular Council meeting will be on July 8th at 7:00 pm, the Council will also be meeting on the 22nd.

Manager Kobrock stated that he has spoken to the Council a couple times in the recent past about the collection of personal taxes by the end of the fiscal year, today alone $25,000 was collected from a very overdue account, along with agreements being signed that will be bringing in over $8,000 in the next couple of months.  There has been a very aggressive push by letters, with-holding permits and licensing to get these results.

Manager Kobrock  received in today’s mail a nomination request for legislative policy committee of Maine Municipal Association,  every Senate District gets two representatives. This is a sixty-member body that advises Maine Municipal Association on legislative policy.  This is something that is interesting, and beneficial to the city by participating, if the Council were interested in nominating the Manager, it could be placed on a future agenda. There were no objections, it will appear on the July 8th agenda.  

The American Traveling Morris, an English dance troupe, have approached the City of Gardiner.  They would like to perform their English folk dancing at the Common on August 17th.  They have performed all over the state, so if there are no objections, they can be authorized to perform at the Common. There were no objections.

6.    COUNCIL DISCUSSION AND PUBLIC COMMENTS

Councilor Hart remarked a constituent came to him with an idea regarding Spring Clean-up.  Instead of having the Spring Clean-up on alternating years, have it yearly by doing the even wards one year, and the odd another.  Manager Kobrock stated that the spring pickup concept is going to be looked at, because it isn’t working the way it is now.  This is a trend that is happening, so there will be some new ideas, and the Manager will report back when that happens. Councilor Hart also stated after the budget is done being worked on, he would like to see the Council discuss e-packets again, seeing if there are ways to be able to save and print certain parts of it.

Councilor Rambo stated that in the past week he has had some discussion with citizens of Gardiner regarding Contract Zoning, and professional/residential districts, thinking that it is important to review and look at.  The Code and Review Committee needs to be updated with membership each January, it has empty seats on the committee. Mayor Rines stated that he is working on membership and it will be finished soon.
Councilor Dellert stated that there is a property on the corner of Church and Pleasant Streets that has recently been sold that has a machine that is parked on the property and sidewalk, can anything be done? Manager Kobrock stated that the sidewalk can definitely be taken care of, but nothing can be done about the machinery.  Councilor Dellert also stated that when the Code and Review Committee membership is formed, Dorothy Washburn should be considered for membership.

Motion by Councilor Webster and seconded by Councilor Dellert to go into Executive Session at 9:45 pm.

Vote: 8 in favor 0 – opposed Motion: passes

2.      EXECUTIVE SESSION per MRSA, Title 1, Chapter 13, Section 405 (6) (C)
        Real Estate Matter

Out of Executive Session at 10:05 pm.

A Real Estate matter was discussed by the Council.

8. ADJOURNMENT

Mayor Rines adjourned the meeting at 10:06 pm.
