MINUTES

1.   CALL TO ORDER AND PLEDGE OF ALLEGIANCE

        The meeting was called to order by Mayor Rines at 7:04 PM

2.   ROLL CALL

3. PETITIONS, COMMUNICATIONS, RESOLUTIONS, & PUBLIC HEARINGS

3.1     Consideration of Comments from the Public on Issues that Do Not Appear Elsewhere on the Agenda (Please limit comments to five minutes)

        Bradley Stover was present to speak to the Council. Mr. Stover lives next to the WWTP and was concerned about short term sludge storage in the building that has an open side, and wondered if  the Council could help.  Mr. Stover is to have a meeting with Chuck Applebee and Jeff Kobrock about his concerns in the near future.

4.  CONSENT AGENDA (All matters listed under this item will be considered routine and will be enacted by one motion.  If a Councilor wishes to discuss one or more listed item(s), the Councilor may ask to have the item(s) removed from the Consent Agenda and considered individually.)

        4.1     Consideration of Accepting January 7th Minutes.
                
        Motion by Councilor Staples and seconded by Councilor Hart  to accept
            Item 4.1

                Vote: 8 in favor 0  opposed Motion: passes

5.  OLD BUSINESS

5.1     Second Reading of Ordinance 01-45, Amending Title 31,    Subsection 3101, 2 (B), (D), (F), (H) & (I) of the Planning Board Bylaws.

Motion by Councilor Hart and seconded by Councilor Dellert to give a Second Reading to Ordinance 01-45, Amending Title 31, Subsection 3101, 2 (B), (D), (F), (H) & (I) of the Planning Board Bylaws.

Vote: 7 in favor 1  opposed (Staples) Motion passes.

6.  NEW BUSINESS
        
6.1     Presentation of Annual Audit  Roger Lebreaux, Runyon, Kersteen, Ouellette.

        Roger Lebreaux was present to the present the Annual Audit to the Council.

6.2     Introduction of Linda Matychowiak, Downtown Manager.

        Chris Paszyc, Economic Development Director, introduced Linda Matychowiak to the Council.  Ms. Matychowiak spoke to the Council expressing her pleasure at starting the new position and her ideas for Downtown Gardiner.

6.3     Consideration of Short Term, Gap Financing for Waterfront Acquisition.

        An appropriation of $117, 189.36 is to be repaid by various funding sources, and the City Manager is to close the purchase as soon as possible.

        Motion by Councilor Dellert and seconded by Councilor Webster to approve Short-term, Gap Financing for Waterfront Acquisition.

        Vote: 8 in favor 0  opposed Motion: passes


6.4     Consideration of Economic Development Committee Loan Recommendation.

        A loan package of $37,500 at 3% for 5 years to the Gardiner Board of Trade.

        Motion by Councilor Webster and seconded by Councilors Dellert and Staples to approve Economic Development Committee Loan Recommendation.

        Motion by Councilor Doiron to amend the previous motion by reducing the loan time from 15 years to 5 years.

        Vote: 8 in favor 0  opposed Motion: passes

6.5     Consideration of Development Agreement for Manson and Church Property.

        Manager Kobrock will enter into the Development Agreement with Jeff & Eva Cole and the Board of Trade, and disburse the grant funding to the Board of Trade.

        Councilor Doiron requested that the approval be contingent upon the City Attorney looking over the agreement.

        Motion by Councilor Staples and seconded by Councilor Dellert to approve Development Agreement for Manson and Church Property Contingent upon City Attorney approving the Final Draft.

        Vote: 8 in favor 0  opposed Motion: passes


7.      CITY MANAGERS REPORT

Manger Kobrock stated that he and Mayor Rines have been discussing what needs to be done now that the Water Study Committee report has been received, the Council reviewed a draft letter to the Water District from the Mayor.  The Water District will be asked to follow up the report with the City.

8.      COUNCIL DISCUSSION AND PUBLIC COMMENTS

Councilor Dellert remarked that the Downtown Merchants are very concerned about the recent sewer rate changes, and would like to set up a meeting time for them to meet with the Council.

Councilor Webster questioned the letter in the packet from the State Planning Office, referring to land on the waterfront, questioning whether this was additional land. Chris Paszyc answered no, the City needed to give extra parking spaces, just complimenting what we already have.

Councilor Doiron asked if the City Manger could check and find out why the Public Works Department was plowing the sidewalks on High Holburn Street late last night.  Manager Kobrock stated that he would check into the matter.

Councilor Staples stated that the school has recently put in two new lights the High School parking area, and she was very pleased.

Councilor Hart apologized for not attending the last Council Meeting.  Councilor Hart also asked if the City Manager could have a budget discussion soon so the Council could find out how everything is looking.  Manager Kobrock stated that it would be discussed at the next Council Meeting.

Mayor Rines asked the City Manager when the Department Heads are being asked to do their budgets, Manager Kobrock stated that they are to have a rough draft on March 1st, a final draft on April 1st and the Council will be receiving it on May 1st.

Mayor Rines also stated that there are discs and books available to Councilors using their laptops who need guidance. When the Website is up and working there will be a Council workshop.

Mayor Rines added that he sent an email to the Council today from Communicable Diseases on community involvement in case of disaster.

9.      ADJOURNMENT TO WORKSHOP (Downtown Update & Housing
Program Overview)

Mayor Rines adjourned the meeting at 9:04 p.m.
