1.      CALL TO ORDER

Mayor Rines called the meeting to order at 7:15 PM

Mayor Rines asked if there were any objections to adding Addendum Items, there were none.
                                                
3.      PETITIONS, COMMUNICATIONS, RESOLUTIONS, & PUBLIC HEARINGS

3.1     Public Hearing – FY 06 Budget for City Services.

Public Hearing opened and closed at 7:16 pm with no public comment.

3.2     Public Hearing – Liquor License Renewal for Gardiner Express House of Pizza.

Public Hearing opened and closed at 7:17 pm with no public comment.

3.3     Public Hearing – Liquor License Renewal for Janelle’s Family Restaurant.

Motion by Councilor Colwell and seconded by Councilor Dellert to Accept Consent Agenda Items 4.1 – 4.5 & Addendum Item 2.

        Vote: 8 in favor 0- opposed Motion: passes

5.      NEW BUSINESS
        
     5.1       Consideration of First Reading of Resolution 05-15, Establishing Appropriations and Directing the Levy of Taxes for City Services.
            
Manager Kobrock stated that the proposed budget would maintain a flat mil rate of 21.8.

     Motion by Councilor Webster and seconded by Councilor Benner to
Accept First Reading of Resolution 05-15, Establishing Appropriations and Directing the Levy of Taxes for City Services.

                Vote: 8 in favor 0- opposed Motion: passes

    5.2        Consideration of Resolution 05-20, Establishing Appropriations for the Enterprise Accounts.

     Motion by Councilor Webster and seconded by Councilor Dellert to
Accept First Reading of Resolution 05-20, Establishing Appropriations for the Enterprise Accounts.

                Vote: 8 in favor 0- opposed Motion: passes

     5.3       Consideration of Order 05-19, Extend Fiscal Year 2005 and Allow the City to Conduct Business until the Fiscal Year 2006 is Adopted.

       Motion by Councilor Colwell and seconded by Councilor Webster to
Accept Order 05-19, Extend Fiscal Year 2005 and Allow the City to Conduct Business until the Fiscal Year 2006 is Adopted.

                Vote: 8 in favor 0- opposed Motion: passes

5.4              Consideration of Zoning Map Change Correction of Clerical Error to
               Zoning Map.

Code Enforcement Officer, Barbara McPheters stated both the Planning Board and the Ordinance Review Committee unanimously voted to recommend that the zone change from Residential Growth back to Planned Development for the property located at 863 Brunswick Avenue, City Tax Map 11, Lot 38.

Motion by Councilor Dellert and seconded by Councilor Rambo to Accept the First Reading of Order 05-24, Zoning Map Change Correction of Clerical Error to Zoning Map.

Vote: 8 in favor 0- opposed Motion: passes

Addendum Item

1.      Consideration of Accepting Loan Resolution from Rural Utilities.

Manager Kobrock stated that Rural Development Loan and Grant for the Wastewater Project requires action on a specific USDA resolution in addition to the usual authorization.     

Motion by Councilor Webster and seconded by Councilor Rambo to Accept Loan Resolution from Rural Utilities.

Vote: 8 in favor 0- opposed Motion: passes


6.      CITY MANAGER REPORT

Manager Kobrock stated that the second reading of the budget will at the next meeting on July 21, where any adjustments that are needed will be taken care of.

There is a memo the walk through at the Central Street School, the Masons were present at the last Council Meeting.  The Housing Committee sees a potential for housing in the building, and would like more time to study.  

7.         COUNCIL DISCUSSION

Councilor Dellert stated that she has received many call concerning the playground.  Manager Kobrock stated that there is a group of families interested in rebuilding, and will be presenting a petition.

Councilor Doiron remarked on the Route 201 road project asking if the manhole covers will remain sticking up in the road, Manager Kobrock stated that there will be another layer put down, and they will be level with road.

Councilor Benner stated that he read the Capitol Weekly article regarding the budget, and wondered the wisdom of stating the results before passage.  Manager Kobrock stated that it is public information and already posted on the webpage.

Councilor Webster congratulated Manager Kobrock on being a Certified City Manager.  Councilor Webster also remarked about the island in Cobbossee Stream where the trees have uprooted, would like to have it researched as to how the City could go about having it removed.  Manager Kobrock stated that it is already being looked into.  

Councilor Rambo asked if the City looking over the Adelphia transfer and deciding if the Gardiner will be joining in with Lewiston and Auburn.  Manager Kobrock stated that the contract is up in April, decisions will be made in the Fall.  Councilor Rambo also asked if there has been any discussion on the Skate Park.  Manager Kobrock stated that no there hasn’t been but a group will be formed for discussion.

Motion by Councilor Webster and seconded by Councilor Dellert to go into Executive Session at 9:30 pm.

Vote: 8 in favor 0 – opposed Motion: passes

8.         EXECUTIVE SESSION per MRSA, Title 1, Chapter 13, Section 405 (6) (D)
                       Union Negotiations

Council directed the City Manager to act as discussed.

Addendum

                       Discuss Legal Matter with City Solicitor

Motion by Councilor Rambo and seconded by Councilor Doiron for the City Manager to Follow-up and Seek Intervention.

Vote: 7 in favor 1 – opposed (Benner) Motion: passes

5.         EXECUTIVE SESSION per MRSA, Title 1, Chapter 13, Section 405 (6) (A)
                       Discuss Legal Matter with City Solicitor

City Council deferred for City Manager for reviewing further.

9.      ADJOURNMENT

Mayor Rines adjourned the meeting at 11:05 pm
