Police Department
The Attorney General released the results of the investigation into the use of deadly force in December 2007 by Officer James Gioia. The Attorney General is required to investigate all circumstances in which deadly force is used by police officers. The report is included in the packet.
The report concludes that Officer Gioia was justified in the use of deadly force. It further reveals that Officer Gioia and State Police troopers made several attempts to defuse the situation and were unsuccessful. The subject was in a highly distraught, emotional state and was entirely unresponsive to these numerous attempts. Officer Gioia has been entirely exonerated.
This extraordinary incident has been handled with the utmost of professionalism. Jim Toman has done a really great job of leading his department through the chaos. It is a real tribute to Chief Toman and the department that an event of such magnitude has been handled so adroitly, on so many levels. I am very proud of our Police Department.
Public service is both a rewarding and challenging occupation. We offer our greatest respect and thanks to Officer Gioia and the entire Gardiner Police Department for their efforts to serve and protect our community.
